Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Kontakt Digital, operating as RawPawIQ ("we," "us," or "our"), governing your access to and use of the rawpawiq.com website and services (the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

To use our Service, you must:

• Be at least 13 years of age
• If you are between 13 and 18 years of age, have the consent of a parent or legal guardian
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws

By using the Service, you represent and warrant that you meet all eligibility requirements. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

To access certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe to be fraudulent.

RawPawIQ provides a pet nutrition platform that helps users create and analyze meal plans for dogs. Our Service includes:

• Nutritional calculation tools based on NRC, AAFCO, and other recognized standards
• An ingredient database with verified nutritional information
• Meal planning and recipe saving features
• Dog profile management
• Compliance analysis and nutritional reporting

We strive to provide accurate information sourced from USDA FoodData Central and verified manufacturer labels. However, ingredient data may vary, and you should always verify nutritional information when precision is critical.

Free and Paid Services

We offer both free and paid subscription plans. Free accounts have access to limited features, while paid subscriptions unlock additional capabilities.

Payment Processing

All payments are processed securely through Stripe. By subscribing to a paid plan, you agree to Stripe's terms of service in addition to these Terms.

Billing Cycle

• Subscriptions are billed in advance on a recurring basis (monthly or annually)
• Your subscription will automatically renew unless cancelled before the renewal date
• You authorize us to charge your payment method for recurring fees

Price Changes

We reserve the right to modify subscription pricing. We will provide at least 30 days' notice before any price increase takes effect. Your continued use after the price change constitutes acceptance of the new pricing.

You retain ownership of content you create through our Service, including saved recipes and dog profiles ("User Content"). By using the Service, you grant us a limited license to:

• Store, process, and display your User Content as needed to provide the Service
• Create backups of your data for disaster recovery purposes
• Use anonymized, aggregated data to improve our Service

You are solely responsible for your User Content and represent that you have all rights necessary to grant us the licenses described above.

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Kontakt Digital and its licensors.

This includes, but is not limited to:

• Our proprietary nutritional calculation algorithms and formulas
• The RawPawIQ name, logo, and branding
• Website design, layout, and user interface
• Curated ingredient database and nutritional data organization
• Documentation, tutorials, and educational content

You may not copy, modify, distribute, sell, or lease any part of our Service, nor may you reverse engineer or attempt to extract the source code, unless permitted by law or with our written consent.

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Submit false or misleading information
• Transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Scrape, harvest, or collect data without permission
• Use automated systems (bots, scrapers) without authorization
• Resell or commercially exploit the Service without permission
• Impersonate another person or entity

Violation of these prohibitions may result in immediate termination of your account and potential legal action.

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
• Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

You agree to defend, indemnify, and hold harmless Kontakt Digital, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of a third party
• Any dietary decisions you make based on information from the Service

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through the following process:

1. Informal Resolution: We encourage you to contact us first to resolve any disputes informally.
2. Mediation: If informal resolution fails, parties agree to attempt mediation before litigation.
3. Jurisdiction: Any legal proceedings shall be brought in the courts of British Columbia, Canada.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

You may terminate your account at any time by contacting us at inbox@rawpawiq.com. Upon termination:

• Your right to use the Service will immediately cease
• We will delete your personal data within 30 days (as per our Privacy Policy)
• Provisions of the Terms that should survive termination will survive

We reserve the right to modify or replace these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date.

For significant changes, we will provide at least 30 days' notice before the new terms take effect. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
